
Specialised Training Seminar “Legal Regulation of Digital Workers’ Labour” Held

On 29 September 2026, a specialised training seminar entitled “Legal Regulation of Digital Workers’ Labour” was held at the Faculty of Law. The seminar was conducted by the research team of grant-funded project AP26198993, “Legal Support for Digital Nomads and Monitoring of Current Issues in Social and Labour Relations in the Context of Digitalisation”.*
The programme focused on the application of the legislation of the Republic of Kazakhstan to remote work and platform work. Topics included determining the legal status of employees and independent contractors, formalising contracts, recording working time and remuneration.
Particular attention was paid to requirements for remote workers’ availability for contact with their employers, the provision of equipment and reimbursement of expenses. The discussion of platform work covered relationships between platform operators, clients and service providers, social security and the legal consequences of blocking accounts.
The practical session included an analysis of hypothetical cases involving the performance of an ongoing employment function under a service contract, urgent assignments outside working hours and disciplinary action based on automated assessments. These examples were used to examine the circumstances that must be established to determine the legal nature of a working relationship and select an appropriate remedy.
The seminar also addressed the limits of digital monitoring, personal data processing and the use of artificial intelligence in decisions affecting workers. For comparison, approaches adopted by the International Labour Organization and the European Union were presented, with explanations of the legal status and scope of the relevant instruments.
The seminar materials were prepared using official legal sources. The discussion aimed to develop skills in the systematic analysis of individual cases, from establishing the actual working arrangements to identifying applicable legal provisions and remedies.
